Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Carma mobile application and related services available at trycarma.app (collectively, the "Service"), operated by Carma ("we," "us," "our").

Please read these Terms carefully. They include important provisions regarding disclaimers of warranties and limitation of liability that affect your legal rights.

By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the consent of your parent or legal guardian, who agrees to be bound by these Terms on your behalf.

You may not use the Service if you are prohibited from doing so under the laws of your country of residence or any country to which the Service is exported.

2. Your Account

To use most features of the Service you must create an account. You agree to:

  • Provide accurate, current, and complete information.
  • Keep your password (or third-party sign-in credentials) confidential.
  • Notify us promptly at support@trycarma.app if you suspect any unauthorized use of your account.

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to comply with the above.

3. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service for your personal, non-commercial use on devices you own or control.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Service.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service, except to the extent that applicable law expressly prohibits such a restriction.
  • Use the Service for any commercial purpose without our prior written consent.

4. Your Content

You retain all rights to the information you record in the Service (vehicle data, service logs, fuel logs, reminders, receipt photos, notes, and similar content — collectively, "Your Content").

By submitting Your Content to the Service you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content solely as necessary to provide the Service to you (and, where applicable, to the household members or transferees you designate).

You represent and warrant that:

  • You own or have the right to upload Your Content.
  • Your Content does not violate any third party's intellectual property, privacy, or publicity rights, or any applicable law.

You are solely responsible for Your Content and the consequences of submitting it.

5. Acceptable Use

You agree not to:

  • Use the Service in any unlawful manner or for any unlawful purpose.
  • Upload content that is illegal, infringing, obscene, threatening, defamatory, or otherwise objectionable.
  • Attempt to gain unauthorized access to other users' accounts, the underlying systems, or any data not intended for you.
  • Interfere with or disrupt the Service or the servers and networks that host it.
  • Scrape, harvest, or extract data from the Service through automated means.
  • Use the Service to send spam, viruses, or any other harmful code.

We may suspend or terminate your account at any time for violations of these Terms, with or without notice.

6. Subscriptions and In-App Purchases

The Service offers optional paid features purchased through Apple's In-App Purchase system. By making a purchase you agree to the terms presented at the time of purchase in addition to these Terms.

  • Payment processing. Apple processes all in-app purchases. Carma does not receive or store your payment card details.
  • Auto-renewing subscriptions. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Manage and cancel subscriptions in your Apple ID settings.
  • Trial period. New users receive a free trial of premium features. Unless cancelled before the trial ends, the trial converts to a paid subscription billed through your Apple ID.
  • Refunds. Apple handles refund requests. Submit refund requests at reportaproblem.apple.com. We do not issue refunds directly.
  • Household plans. If you purchase a household plan and invite other users, they receive access to premium features for as long as your subscription remains active. You are responsible for the conduct of users you invite.

7. Vehicle Data Disclaimer

Carma is record-keeping software. It is not a substitute for professional vehicle inspection, mechanical advice, or any safety-critical decision.

  • The reminders, mileage projections, and "next due" estimates that Carma generates are based on the intervals and odometer readings you enter. They are guidance, not professional vehicle-maintenance advice.
  • Carma does not warrant that any reminder will fire on time, that any MPG or cost calculation is correct, or that any data populated from third-party sources (such as NHTSA VIN decodes) is accurate or current.
  • You should always rely on your vehicle manufacturer's recommendations, qualified mechanics, and direct inspection for any decision that affects vehicle safety, roadworthiness, warranty, or compliance with law.

8. Third-Party Services

The Service integrates with third-party services (including Apple, Google, Supabase, Resend, and the NHTSA VIN decode API). Your use of those third-party services is governed by their own terms and privacy policies. We are not responsible for the content, accuracy, or practices of any third-party service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY DATA YOU STORE IN THE SERVICE WILL BE PRESERVED OR THAT BACKUPS WILL BE MAINTAINED, AND YOU SHOULD MAINTAIN YOUR OWN COPIES OF CRITICAL INFORMATION.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CARMA OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100 USD).

THE FOREGOING LIMITATIONS APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless Carma and its officers, directors, employees, and agents from any claim, demand, or damages (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service,
  • Your Content,
  • Your violation of these Terms, or
  • Your violation of any rights of another party.

12. Termination

You may stop using the Service at any time and delete your account from Account → Delete Account. Account deletion is permanent and irreversible.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service immediately ceases. Sections 4, 9, 10, 11, 13, 14, and 15 survive termination.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email at least seven (7) days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of [STATE TO BE DETERMINED], without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in [COUNTY, STATE], and you consent to the personal jurisdiction of those courts.

Note for publisher: replace the bracketed placeholders above with your actual jurisdiction before publishing. A lawyer should advise on whether to include an arbitration clause or class-action waiver based on where you intend to operate.

15. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Carma regarding the Service and supersede any prior agreements.
  • Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
  • No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
